The Competition

1. These Terms and Conditions (the “T&Cs”) shall govern and apply to all competitions published on the Promoter’s website at www.pandagiveaways.com (the “Website”), including but not limited to standard competitions (“Standard Competitions”) and online instant win competitions (“Instant Win Competitions”). For the purposes of these T&Cs, Standard Competitions and Instant Win Competitions are collectively referred to as the “Competitions,” and any reference to a “Competition” shall mean either a Standard Competition or an Instant Win Competition.
 
2.In the event of any inconsistency or conflict between these T&Cs and any listing on the Website, advertisement, or any other material employed by the Promoter in connection with the promotion of a Competition, these T&Cs shall prevail.
 
3.To participate validly and to be eligible for the opportunity to win, each individual who enters a Competition (an “Entrant”) shall be required to correctly answer a question or solve a problem as prescribed by the Promoter (the “Competition Question”).
 
4.Each Competition shall incorporate a Competition Question, and an entry fee shall be payable for each entry submitted. Where the Promoter provides an easy or multiple-choice question, an alternative free entry route shall be made available.

How to Enter

1.Competitions shall operate from and including the opening and closing dates specified on the Website (the “Opening Date” and the “Closing Date,” respectively). All times and dates specified shall be construed as times and dates in London, England.
 
2.The Promoter reserves the right, where deemed absolutely necessary, to amend the Opening Date and/or the Closing Date. Any such amendment shall be published on the Website, and the revised dates shall apply.
 
3.All Competition entries must be received by the Promoter no later than the specified time on the Closing Date. Subject to clause 3.12.6 below, any entries received after the specified time on the Closing Date shall be automatically disqualified, and no refunds shall be issued.
 
4.The maximum number of entries permitted for a Competition shall be stated on the Website. The number of entries you may submit may be restricted if and when the maximum capacity is reached.
 
5.Entries, including free entries, shall be limited per person per Competition. The maximum number of entries permitted per Entrant for each Competition shall be specified on the relevant Competition webpage on the Website. No further entries shall be accepted once the maximum limit has been reached.
 
6.To enter a Standard Competition using the paid entry route, an Entrant shall:
 
  • Visit the Website and access the Standard Competition they wish to enter;
  • Input their answer to the Competition Question;
  • Select the desired number of entries and proceed to checkout;
  • Log in or register for an account if not already logged in; and
  • Agree to the T&Cs and complete the purchase.

7. To enter an Instant Win Competition using the paid entry route, an Entrant shall:

  • Visit the Website and access the Instant Win Competition they wish to enter;
  • Select the desired number of entries and proceed to checkout;
  • Log in or register for an account if not already logged in; and
  • Agree to the T&Cs and complete the purchase.
8. Use of PayPal is strictly limited to persons aged 18 years or older. Entrants shall also be bound by PayPal’s terms and conditions governing its use.
 
9.Where an entry is purchased online, the Promoter shall issue confirmation that the entry has been received.
 
10.The Promoter shall not be liable for entries which are not successfully completed, are lost, delayed, or otherwise fail to be delivered, regardless of cause, including but not limited to equipment failure, technical malfunction, system error, satellite or network issues, server failure, or hardware or software malfunction of any kind.
 
11.By purchasing or submitting an entry (whether via the paid entry route or via a free entry route), the Entrant confirms their eligibility to enter the Competition, acknowledges that they are entering into a binding contract with the Promoter, and agrees to be bound by these T&Cs.
 
12.An Entrant may enter a Competition (whether a Standard Competition or an Instant Win Competition) for free, subject to compliance with the following conditions:
Entries must be sent by pre-paid first- or second-class post to the Promoter at: 10 Sharman Road , NN5 5JZ , Northampton , Northamptonshire , UK. 
Hand-delivered entries shall not be accepted and shall not be entered into the random draw.
 
Each free entry must include:
  • Details of the Competition the Entrant wishes to enter;
  •  The Entrant’s full name;
  •  The Entrant’s date of birth;
  • The Entrant’s postal address;
  • A contact telephone number and email address
  • The Entrant’s answer to any Competition Question
 
Incomplete or illegible entries shall be disqualified.
 
Multiple free entries may be made for any Competition up to the maximum number permitted per Entrant, as specified on the relevant Competition webpage. Each free entry must be submitted and posted separately. Bulk entries contained within one envelope or on one postcard shall be treated as a single entry.
 
Free entries must be received by the Promoter before the Closing Date and prior to all tickets in a Competition being allocated. Free entries received within 48 hours of the Closing Date for a Competition in which tickets remain unsold or unallocated shall not be entered but shall instead receive Website account credit equal to the corresponding number of paid entries. Free entries received after the Closing Date shall not be eligible for credit. Proof of posting shall not constitute proof of receipt and shall not be accepted as evidence of entry.
 
Where the entry cap or limit is reached before a free entry is received, the Entrant shall not be entered into the Competition or any other Competition, nor shall they receive Website account credit.
 
If the Competition entry fee is less than the cost of second-class postage, multiple entries shall be credited for each postal entry in accordance with the following scale:
  • 49p Competitions – 1 postal entry = 2 Competition entries
  • 29p Competitions – 1 postal entry = 3 Competition entries
  • 9p Competitions – 1 postal entry = 10 Competition entries
Entrants must have created an account on the Website or App for any free entry to be processed, and all details provided in the free entry must exactly match the details registered on the Entrant’s account.

Choosing a Winner

1. In respect of Standard Competitions, all Entrants who correctly answer the Competition Question shall be entered into a random draw. One Entrant shall be selected by such random draw to be eligible to receive the Prize. The random draw shall be conducted as soon as reasonably practicable and, in any event, within seven (7) days following the Closing Date (the “Draw Date”).
 
2.All Entrants in a Standard Competition shall have their names and entry numbers recorded on a spreadsheet. Such spreadsheet may be published on the Website and may also be displayed during the live draw. Any Entrant who does not wish to have their name published on the spreadsheet must notify the Promoter by email at admin@pandagiveaways.com as soon as reasonably practicable after submitting their entry, and in any event no later than forty-eight (48) hours prior to the live draw.
 
3.In respect of Instant Win Competitions, prizes shall be allocated at random to numbers listed in a spreadsheet. Each entry correctly answering the Competition Question shall then be randomly assigned a number on that spreadsheet. In the event that the allocated number corresponds to a prize, the Entrant shall be deemed to have won that prize.
 
4.Entrants entering via both the paid entry route and the free entry route shall be notified of whether they have won, and if so, which prize they have won, immediately following submission of their entry by reference to the webpage of the relevant Instant Win Competition.
 
5.Entrants entering via both the paid entry route and the free entry route shall further be notified of the outcome by means of an automated email sent to the contact email address provided at the time of entry. Such email shall be generated automatically at the point at which the Entrant’s number is identified as a winning number. Entrants who are unsuccessful shall also be notified by email.
 
6.Entrants determined to be eligible to receive a Prize in accordance with clauses 4.1 and 4.3 herein shall be designated individually as a “Winner” and collectively as the “Winners.”

Credit Site

1. Credit Site may, at the discretion of the Promoter, be awarded as gifts or as Prizes in certain Competitions.
 
2.Certain Prizes in Competitions may, if expressly stated on the relevant Competition webpage, be exchanged for Credit Site.
 
3.Entrants may also be awarded Credit Site upon submission of photographs and/or testimonials relating to their Competition win, provided such materials meet the Promoter’s criteria as communicated at the time.
 
4.Additional opportunities to be awarded Credit Site may be announced through the Promoter’s social media campaigns.
 
5.Credit Site must be used within twelve (12) months from the date on which they are credited to the Entrant’s Website account. Users shall receive a reminder notification one (1) month prior to expiry and again on the date of expiry. Any Credit Site not used within this period shall expire automatically and shall no longer be capable of redemption as a discount against Competition entries.
 
6.The current balance of Credit Site allocated to an Entrant may be viewed at any time by logging into the Entrant’s Website account.
 
7.Credit Site shall not carry any monetary value, shall not constitute legal tender, and shall not be capable of being exchanged for cash or real-world money.

Eligibility

The Competition is open to all residents aged eighteen (18) years or over, save that the following persons shall be excluded from entry:

  • Employees of the Promoter;
  • Employees of any agents or suppliers of the Promoter who are professionally connected with the Competition or its administration;
  • Members of the immediate families or households of those persons referred to in clauses 6.1.1 and 6.1.2 above.

By submitting an entry into the Competition, you confirm and warrant that you are eligible to do so and eligible to claim any Prize you may win. The Promoter reserves the right to require you to provide such proof of eligibility as it may reasonably request. Failure to provide such proof within a reasonable period may result in your disqualification from the Competition. The Promoter shall not accept Competition entries that are:

  • Automatically generated by computer;
  • Incomplete

The Promoter reserves the right to disqualify any Entrant whose conduct is, in its opinion, contrary to the spirit or intention of the Competition. This includes, without limitation, instances where the Entrant is rude or abusive towards the Promoter or any person associated with the Competition.

Subject to clause 12.3 herein, no refunds of the entry fee shall be made under any circumstances, including (without limitation) in the following situations:

  • Where, after submitting an entry, you subsequently discover that you are not eligible to enter the Competition or to claim the Prize;
  • Where, after your entry, the eligibility criteria for entry or for claiming the Prize are amended and you no longer satisfy such criteria; or
  • Where you are disqualified by the Promoter for any reason.

In the event that an Entrant engages in any of the following conduct:

  • Any form of fraud (whether actual or apparent);
  • Fraudulent misrepresentation;
  • Fraudulent concealment;
  • Hacking or other interference with the proper functioning of the Website; or
  • Alteration, amendment, or unauthorised use of any of the code that constitutes the Website, then all entries submitted by such Entrant shall be declared void, no refunds shall be issued, and the Entrant may be prohibited from participating in any future Competitions.

The Prize

1. The prize for each Competition shall be as described on the Website (the “Prize”). All details of the Prize are, to the best of the Promoter’s knowledge, information, and belief, accurate as at the Opening Date.
 
2.All Prizes are subject to availability. The Promoter reserves the right to substitute any Prize with another of equal or greater value. Should any details of the Prize change, the Promoter shall use reasonable endeavours to update the Website as soon as practicable. In respect of Instant Win Competitions, the Prizes listed on the Website represent those available to be won; however, there is no guarantee that all Prizes will be won, as this shall depend on the number of entries received.
 
3.The Promoter shall take reasonable steps to award the Prize as described on the Website. The Promoter makes no representation and provides no warranty as to the Prize, its value, condition, quality, suitability, or any other description provided on the Website. The Promoter further makes no representation or warranty that the information published on the Website is accurate, complete, or up to date.
 
4.There shall be no cash alternative to the Prize unless expressly stated on the relevant Competition webpage. Notwithstanding the foregoing, the Promoter may, in its sole discretion, provide a cash alternative should the Winner elect to receive cash in lieu of the Prize.
 
5.The Prize shall be non-refundable, non-negotiable, and non-transferable.
 
6.If the Prize is a vehicle:
  • The Promoter shall, unless otherwise stated, ensure that it is supplied with a valid MOT certificate (where legally required);
  • No insurance is included, and it shall be the Winner’s sole responsibility to ensure that the vehicle is adequately insured prior to use on public roads (where lawful);
  • The Promoter shall bear no responsibility for the Prize once delivered. The Winner shall be solely responsible for compliance with all laws and regulations relating to the vehicle, including its safe and lawful operation;
  • Vehicle/road tax shall not be included;
  • The Winner shall be solely responsible for ensuring that they hold all necessary licences, qualifications, knowledge, and experience to operate the vehicle safely and legally;
  • The Winner shall be solely responsible for procuring and utilising all necessary safety equipment and clothing (including, without limitation, helmets, boots, and gloves) when operating the vehicle.

7. If the Prize is a holiday or event:

  • The description published on the Website shall specify the number of tickets included, the class of transport, the type of carrier, and the relevant travel destination. Depending on the nature of the Prize, dates may be fixed (e.g., Grand Prix tickets) or flexible (e.g., a generic holiday). Excluded dates shall be as specified on the Website. The Prize shall not include travel insurance, transfers to or from airports or stations, food and drink, spending money, taxes, personal expenses, or any other items not expressly stated on the Website. Any costs incurred in addition to those set out above shall be the sole responsibility of the Winner. A cash supplement may be included if expressly stated on the Website; such cash supplement shall constitute the full extent of the Promoter’s liability.
  • The Winner shall be responsible for ensuring that they and any accompanying persons are available to travel on the specified dates and hold valid passports, visas, and any other required travel documents. Once notified to the travel agent, travel dates shall not be changeable.

8. If the Prize is a property:

  • The Winner shall have the option to select either: the property, furnishings, and any cash supplement, each as described on the relevant Competition webpage; or a cash Prize, as stated on the relevant Competition webpage.
  • The property value indicated on the Website shall be indicative only, and the actual value may vary owing to market conditions or other factors.
  • The Promoter shall bear any Stamp Duty Land Tax and reasonable legal costs associated with the transfer of title. All other taxes, costs, and fees shall be the sole responsibility of the Winner.
  • The property may be subject to certain rights, restrictions, or covenants as specified in its title documents.
  • The Promoter reserves the right to substitute the property and furnishings with an alternative Prize of equal or greater retail value, at any time.
  • The Winner shall cooperate fully with the Promoter to complete and register the title transfer, using all reasonable endeavours to finalise such transfer within ninety (90) days of electing the property as the Prize. Failure to do so shall trigger the application of clause 8.6 below.
  • Where the Winner elects the cash Prize, payment shall be made within fourteen (14) working days of the Promoter receiving written confirmation of such election together with validated bank account details.

Winners

1. The decision of the Promoter shall be final, and no correspondence or discussion shall be entered into.
 
2.In respect of Standard Competitions, the Promoter shall contact the Winner personally as soon as practicable following the Draw Date specified in the Competition listing on the Website, and in any event no later than seven (7) days thereafter, using the telephone number or email address provided with the entry. Where the Winner cannot be contacted, is unavailable, or fails to claim the Prize within fourteen (14) days of the Draw Date, the Promoter reserves the right to award the Prize to the next eligible Entrant selected in the same manner as the original Winner from among the correct entries received prior to the Closing Date.
 
3.In respect of Instant Win Competitions, Entrants entering via both the paid entry route and the free entry route shall be informed online, on the relevant Competition webpage, whether they have won. The Promoter shall additionally contact Winners personally as soon as practicable following their winning entry and, in any event, within forty-eight (48) hours of receipt of such entry, using the telephone number or email address provided at the time of entry. Where the Winner cannot be contacted, is unavailable, or fails to claim the Prize within fourteen (14) days of the Promoter’s first attempt to make contact, the Promoter reserves the right to allocate a new number to the Prize and either (i) return it to the prize pool for the Competition, or (ii) dispose of it in such manner as the Promoter deems appropriate, without any liability to the original Winner.
 
4.The Promoter is obliged to publish or otherwise make available information confirming that a valid award has taken place. To fulfil this obligation, the Promoter shall publish the name and winning number of Winners on the Website and shall also provide such information to any person who entered the Competition upon request.
 
5.If you object to the publication or disclosure of any or all of your name and winning entry, you must notify the Promoter at admin@pandagiveaways.com prior to the Closing Date. Notwithstanding such objection, the Promoter shall remain obliged to disclose such information to the Advertising Standards Authority upon request.
 
6.The Promoter reserves the right to forfeit a Prize where it has reasonable grounds to suspect that a Winner is not eligible or has failed to comply with these T&Cs. In such circumstances, the Promoter may dispose of the Prize in its sole discretion and without liability to the Winner.

Claiming the Prize

1. Winners must claim the Prize personally. Prizes shall not be claimable by any third party on behalf of a Winner. The method of delivery of the Prize (or, where applicable, the arrangements for collection) shall be as published on the Website.
 
2.Entrants are responsible for ensuring that their personal details, including contact information, remain accurate and up to date. Any change of details must be notified to the Promoter as soon as reasonably practicable by email to admin@pandagiveaways.com. Such notification must specify the Competition entered, the Entrant’s previous details, and the updated details. Where details change within ten (10) days prior to the Closing Date, the Promoter shall use the details previously provided for the purpose of attempting to contact the Winner.
 
3.In the case of a cash Prize, payment shall be made directly to the Winner’s nominated bank account. The Winner must provide evidence that they are the sole or joint beneficiary of such account. Failure to provide such evidence within fourteen (14) days shall result in disqualification and forfeiture of the Prize. In such circumstances, the Promoter reserves the right to (i) award the Prize to the next eligible Entrant selected from the correct entries received prior to the Closing Date; or (ii) in the case of an Instant Win Competition, dispose of the Prize in such manner as it sees fit, without liability to the disqualified Winner.
 
4.The Promoter shall not accept responsibility or be liable to pay compensation where a Winner is unable or unwilling to take up the Prize.
 
5.The Promoter reserves the right not to award any Prize where it has not been claimed by the Winner in accordance with these T&Cs.

Limitation of Liability

1. Insofar as permitted by law, the Promoter, its agents, or distributors shall not in any circumstances be responsible or liable to compensate the Winner, nor shall they accept liability for any loss, damage, personal injury, or death arising out of or in connection with the Winner’s taking up of the Prize, except where such loss, damage, personal injury, or death is caused by the negligence of the Promoter, its agents, distributors, or their employees. Nothing in these T&Cs shall exclude or limit your statutory rights.
 
2.Without prejudice to the generality of clause 10.1, the Promoter shall not be liable for any of the following:
  • Entries not received due to incorrect or inaccurate entry information, faulty or failed data transmissions, or any other cause;
  • Unauthorised access to, theft of, destruction of, or alteration to entries at any stage of the Competition;
3.Technical malfunctions, errors, failures, omissions, interruptions, deletions, defects, delays in operation, or communications line failures of any kind, however caused, in relation to equipment, systems, networks, lines, satellites, servers, computers, or providers used in connection with the operation of the Competition;
 
4.Inaccessibility or unavailability of network services, wireless services, the internet, or the Website (including, without limitation, any online method used for the random selection of Prize draws) 
 
5.Any loss or damage arising directly or indirectly from the Winner’s use of the Prize.
 

Data Protection and Publicity

1. By entering a Competition, you consent to the Promoter and its agents or suppliers holding and using any personal information you provide solely for the purposes of administering the Competition or as otherwise set out in the Promoter’s Privacy Policy, available on the Website.
 
2.If you are a Winner, you consent to the Promoter using your name, image, and town or county of residence to announce the Competition results and to participate in any reasonable publicity required by the Promoter.
 
3.If you do not wish to participate in publicity, you must notify the Promoter prior to the Closing Date. This will not affect your eligibility to win. The Promoter may, however, still provide your details to the Advertising Standards Authority to comply with legal requirements demonstrating that the Competition has been fairly administered and the Prize awarded.
 
4.Winners may be required to provide additional personal information and proof of identity to confirm eligibility and transfer ownership of the Prize. By entering, you consent to such use of your information. You may request details of how your information is used. Withdrawing consent may prevent transfer of the Prize, resulting in forfeiture and no refund of any entry fee. In such cases:
  • For Standard Competitions, the Prize may be offered to the next eligible Entrant from valid entries received before the Closing Date.
  • For Instant Win Competitions, the Promoter may dispose of the Prize at its discretion without liability to the Winner.

Under data protection laws, you may request that the Promoter ceases contacting you and removes your details from its database. Doing so constitutes withdrawal from the Competition, and no refund of any entry fee will be provided. If you do not want your personal details used for promotional purposes, notify the Promoter via email at admin@pandagiveaways.com before the Closing Date.

 

GENERAL

1. The Promoter reserves the right to amend these T&Cs at any time. The latest version will always be available on the Website.
 
2.If the Promoter believes there has been a breach of these T&Cs, it may, at its sole discretion, exclude you from participating in the Competition or any future Competitions.
 
3.The Promoter reserves the right to void, suspend, cancel, or amend the Competition where necessary due to circumstances beyond its control. In such cases, any entry fees paid will be refunded.
 
4.There is no minimum number of entries required. The Promoter will not void, suspend, cancel, extend the Closing Date, or amend the Competition due to a lack of entries. The draw will take place and the Prize will be awarded regardless of the number of entries received.
 
5.The Competitions on the Website are in no way sponsored, endorsed, administered by, or associated with Facebook. By entering, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the Competitions.
 
6.These T&Cs are governed by English law, and Entrants submit to the jurisdiction of the courts of England and Wales.
 
7.You should print a copy of these T&Cs and keep them for your records.
